By placing any service request order with Blue Water Legal Process LLC, you are entering into a legally binding agreement service contract and agree to be fully bound by all the following terms of service:
Blue Water Legal Process LLC will make 3-4 service attempts of your legal documents with the first attempt being within the time frame listed for your service priority type. We will attempt to make one morning, one afternoon, one evening and one weekend Saturday attempt as needed. No service attempts will be made on Sundays or any holiday. If service cannot be completed within the attempts or Blue Water Legal Process LLC gains other information where the service cannot be completed, Blue Water Legal Process LLC will refer back to you for one week before issuing a non-service affidavit.
You understand that you are paying for ATTEMPTS of service and that the actual guarantee of successful service of the documents is never fully guaranteed. At that point, Blue Water Legal Process LLC will issue a due diligence affidavit to you to obtain an alternative service order from the court if desired.
You agree to a Force Majeure Clause with these terms of service. There are situations that could arise on both a Civil or Weather-related incident that are completely out of the control of Blue Water Legal Process LLC that could delay or even prevent service of legal process from happening. Blue Water Legal Process LLC will be proactive in all these circumstances and will update via email and message pop-up on the main page of our website regarding any possible delays.
You agree to hold Blue Water Legal Process LLC and all members of staff harmless if these circumstances were to arise.
After services are completed, Blue Water Legal Process LLC will issue an Invoice for Services to you. Once the invoice is issued, you agree to pay the Invoice of Service within thirty days. You fully understand and agree that if the Invoice for Service remains unpaid after the thirty days, that a 1.5% late fee will be added to the current balance each month that the balance remains unpaid.
It is the full legal responsibility of the client to ensure that their check payment clears their bank. In the event that a client check comes back as a NSF Check, Blue Water Legal Process LLC will follow MCL 600.2952 regarding the collection of the check. If the client fails to make payment on an NSF Check within the stated time frames, client agrees to be legally bound to MCL 600.2952(4) regarding any court action and allowed fees regarding an NSF Check.
Both Blue Water Legal Process LLC and the client agree that all sections of this contact shall be governed and enforced under the laws of the State of Michigan.
